Bus passenger accuses public transport agency of negligence

HOUSTON — A Harris County bus passenger is suing the county transit authority, alleging negligence led to injuries for the plaintiff. 

Raul Guerrero filed a complaint Jan. 27 in Harris County District Court against the Metropolitan Transit Authority of Harris County and First Transit Inc., alleging they failed to properly train employees to exercise ordinary care while operating the bus.

According to the complaint, on May 28, 2015, while Guerrero was exiting a bus owned and operated by the defendants, the bus driver closed the door before the plaintiff was able to make his way completely out of the bus. 

The suit says Guerrero fell to the ground and suffered bodily injuries to his back, neck, left arm and right leg. As a result, the lawsuit states, the plaintiff suffered physical pain, mental anguish, loss of earnings and medical expenses. 

The plaintiff alleges the defendants' bus driver let the door closed on Guerrero, failed to wait for him to safely exit the bus and drove away without verifying whether the plaintiff had safely exited the bus.

Guerrero seeks trial by jury, monetary relief between $100,000 and $200,000, pre- and post-judgment interest, costs of court and all other equitable relief. He is represented by attorney Adam J. Rosenfeld of Schechter McElwee, Shaffer and Harris, LLP in Houston.
