Customer blames vacation provider, water slide operator for injuries

HOUSTON — A Harris County man is suing a vacation provider and water slide operator, alleging negligence led to the plaintiff suffering injuries. 

Richard James Tate filed a lawsuit Jan. 30 in the Houston Division of the Southern District of Texas against RCI LLC and Vallarta Adventures SA de CV, alleging RCI failed to use reasonable care in selecting the tour on which the plaintiff was injured.

According to the complaint, on July 21, 2016, Tate was injured when a Vallarta Adventures employee prematurely and negligently pushed a larger participant down the hillside water-slide in Puerta Vallarta, Mexico, while Tate was already occupying the slide. 

The suit says Tate was injured, resulting in physical and mental pain, medical expenses, disability and physical impairment. The plaintiff alleges Vallarta Adventures negligently designed the water slide and the process by which persons are hurtled down it and negligently failed to train and supervise its employees operating the water slide.

Tate seeks trial by jury, actual and exemplary damages of more than $500,000, pre- and post-judgment interest, costs of court and all other equitable relief. He is represented by attorney C. Chad Pinkerton of The Pinkerton Law Firm PLLC in Houston.
