Senior care facility operator accuses bar business of noise violations

HOUSTON — A Houston senior care facility operator is suing a bar business and a leasing company, alleging interference of private use and enjoyment of property.

S-H OpCo Vintage Park AL LLC filed a complaint Jan. 26 in Harris County District Court against Arbed VP LLC, doing business as Mo's Irish Pub and Dunhill Partners Inc., alleging failure to comply with the city of Houston's noise ordinance.

According to the complaint, in spring 2015, S-H OpCo Vintage Park began receiving numerous complaints from residents regarding the noise emanating from Mo's Irish Pub, of not being able to sleep and witnessing public urination and fighting by the bar's customers. 

As a result, the suit says, the senior care facility has suffered loss of business, lost profits and loss of good will. The plaintiff alleges the defendants have created and continues to create a nuisance and failed to address the noise problem.

S-H OpCo Vintage Park seeks trial by jury, monetary relief between $100,000 and $500,000, temporary and permanent injunction enjoining the defendant from causing sound levels in excess of the applicable noise ordinance, actual and exemplary damages, pre- and post-judgment interest, attorney fees, court costs and all other just and equitable relief.
