HOUSTON — An executive assistant is suing a Hispanic marketing agency, alleging violation of workers compensation acts in not paying proper overtime.
Lupita Montalvan filed a complaint Feb. 6 in the Houston Division of the Southern District of Texas against Lopez Negrete Communications Inc., alleging violation of the Fair Labor Standards Act.
According to the complaint, between Dec. 3, 2013 and Jan. 15, 2016, Montalvan regularly worked more than 40 hours per week as an executive assistant with no overtime pay. The plaintiff alleges Lopez Negrete Communications did not pay her time-and-one-half of her regular rate of pay for all hours she worked more than 40 a week as required by FLSA.
Montalvan seeks trial by jury, judgment for her unpaid overtime wages, liquidated damages, attorney fees, court costs and expenses, post-judgment interest and all other proper relief. She is represented by attorney Nichole M. Nech of The Nech Law Firm PC in Houston.
