Employee alleges staffing company failed to pay overtime

HOUSTON — An employee has filed a class action lawsuit against a staffing company, alleging violation of workers compensation acts in not paying proper overtime wages.

John Morgan filed a complaint, individually and on behalf of all others similarly situated, Feb. 6 in the Houston Division of the Southern District of Texas against SL Global Investments LLC doing business as Field Personnel Resources, alleging violation of the Fair Labor Standards Act.

According to the complaint, Morgan normally worked more than 40 hours a week without being paid the overtime premium. The plaintiff alleges the defendant failed to pay overtime at the statutory rate of one-and-one-half times Morgan's regular rate for all hours worked past 40 per week as required by FLSA.

Morgan seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime compensation, liquidated damages, attorney fees and court costs, pre- and post-judgment and all other just and proper relief. He is represented by attorneys Richard J. (Rex) Burch and David I. Moulton of Bruckner Burch PLLC in Houston.
