Restaurant chain accuses competitor of trademark violation

HOUSTON — Restaurant chain operators are suing competitors, alleging trademark violation.

Isaias Rosales, individually and doing business as Pollos Asados El Regio, Pollos Asados El Regio, El Regio Pollos Asados, et al filed a complaint March 9 in the Houston Division of the Southern District of Texas against Jose Juan Bazaldua and El Pollo Regio IP LLC, alleging failure to comply with Lanham Act regulations.

According to the complaint, the defendants’ activities have caused and will continue to cause irreparable monetary injury to the plaintiffs business, reputation and good will, unless defendants are enjoined by the court. 

The plaintiffs allege the defendants registered a logo of a cartoon chicken and business name Pollo Regio that are similar to the plaintiffs' original creation and without the plaintiffs' authorization or permission.

The plaintiffs seek trial by jury, permanent injunction enjoining the defendants from using the mark of the cartoon chicken with a cowboy hat and from using of the name Pollos Asados El Regio/El Pollo Regio, declaring the plaintiffs as senior users of such names, plus court costs, attorney fees and all other just and equitable relief. They are represented by attorneys Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
