Cook, dishwashers accuse Italian restaurant operators of failing to pay overtime

HOUSTON — A cook and dishwashers are suing Houston Italian restaurant operators, alleging unpaid minimum and overtime wages.

Marco T. Diaz, Juan Victor Garcia, Hector Gomez and Jose Yax Yax filed a complaint Feb. 10, in the Houston Division of the Southern District of Texas against Mascalzone Texas LLC and Mascalzone Washington LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Diaz, Garcia, Gomez and Yax consistently worked more than 40 hours per week, but were paid the same hourly rate for all hours and were not paid one and one-half times their regular rate of pay for hours worked more than 40 per week as required by FLSA. 

The plaintiffs seek trial by jury, all unpaid minimum and overtime wages, liquidated damages, prejudgment interest, attorney fees and costs and all just an equitable relief. They are represented by attorney Josef F. Buenker of The Buenker Law Firm in Houston.
