Homeowner alleges contractors violated warranty

GALVESTON — A Galveston County homeowner is suing contractors, alleging breach of warranty.

Rodney Harrison filed a complaint Feb. 14 in Galveston County District Court against David Wayne Robertson, and D. W. Robertson Homes LLC, alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, the defendants' wrongful conduct caused Harrison to suffer economic losses in excess of the minimal jurisdictional limits of this court. The plaintiff alleges the defendants failed to complete the work on Harrison's new home in Kemah in a manner consistent with the parties' contract and generally accepted construction standards and failed and refused to cure the various defective conditions.

Harrison seeks trial by jury, monetary relief of between $200,000 and $1 million and all other equitable relief. He is represented by attorneys Joel Rehman and Sarah K. Payne of Sullins Johnston Rohrbach & Magers in Houston.
