Utah man suffers broken nose during sailing class, sues over unsecured boom

GALVESTON – A Utah man has filed a lawsuit after he allegedly suffered a broken nose during a sailing class late last year, according to recent Galveston County District Court records.

Logan, Utah resident David Matthew Stewart sued Gordy Enterprises, L.L.C.; Sackett’s Sailing Center; Bay Area Sailing School; and Vachule Enterprises, LLC in the Galveston County 56th District Court on Mar. 9.

Stewart explains that he and some friends were enrolled with the defendants to receive their sailing certifications, stating that he was in the midst of finalizing his “man overboard” certification at the time of the subject incident.

“During his teaching for this certification, he was instructed by Defendant to perform a certain maneuver and as he was doing so, the after part of the boom swung around and slammed into Stewart’s face, breaking his nose,” the suit says.

The respondents purportedly lacked first aid equipment to which Stewart asserts that he “was only provided with dirty tissues to assist in the bleeding.”

The suit further faults the defendants for not securing the boom.

Consequently, Stewart seeks unspecified monetary damages and a jury trial.
