Customer alleges Wal-Mart negligence led to injuries

TEXARKANA — A customer is suing Wal-Mart, alleging the store's negligence led to injuries for the plaintiff.

Henry Lee Tapley of Paris, Texas, filed a complaint Feb. 22 in the Texarkana Division of the Eastern District of Texas against Wal-Mart Stores, Inc. doing business as Wal-Mart Supercenter, alleging the store failed to make the premises safe or adequately warn patrons of the dangerous condition.

According to the complaint, on June 16, 2016, Tapley was an invitee at Wal-Mart property in Paris when she was injured due to a pallet jack being operated on the sales floor in an unsafe manner. As a result, Tapley says he suffered physical injuries, pain and incurred medical expenses. 

The plaintiff alleges Wal-Mart Supercenter failed to use the pallet jack in a safe manner, failed to timely stop the pallet jack, failed to adequately warn patrons regarding the pallet jack and failed to adopt and implement policies for the safe operation of pallet jacks within the store.

Tapley seeks trial by jury, damages, pre- and post-judgment interest, costs of court and all other equitable relief. He is represented by attorney J. Stephen Walker of Moore Law Firm LLP in Paris.
