Texas City man sues to get used car payment

GALVESTON — A Texas City resident has filed suit after the person who purchased a car from him allegedly failed to pay the agreed-upon amount. 

Wilbur Pettyjohn filed a complaint on Feb. 23, in the Galveston County District Court against another Texas City resident, Julia Spain, alleging that the buyer failed to meet her obligation under the sales agreement.

According to the complaint, the plaintiff said he agreed to sell the defendant a 2004 Mercury automobile on Oct. 2, 2015, for $4,900. After receiving the initial payment of $1,000, he never received the balance. The plaintiff holds Spain responsible because the defendant allegedly failed and refused to pay the balance of the sales price.

The plaintiff requests a trial by jury and seeks judgment against defendant for the balance of $3,900, plus interest, attorney fees and other relief. He is represented by Thomas Cain of Mabry, Herbeck & Roberts in Texas City.
