Metalworker sues employer over workplace injury

HOUSTON — A metalworker is suing Alabama Metal Industries and an employment agency, Automation Temporary Service, alleging insufficient measures were taken to prevent workplace injuries.

Reyes Martin Chavez filed a complaint on Feb. 27, in the Harris County District Court against the defendants, alleging that they failed to follow Occupational Safety and Health Administration regulations.

According to the complaint, the plaintiff alleges that while in the course of his employment on Oct. 24, 2015, he sustained injuries to his right hand. He suffered physical and mental pain, loss of earnings and medical expenses, the complaint said. The plaintiff holds Alabama Metal Industries and Automation Temporary Service responsible because the defendants allegedly failed to provide necessary tools and equipment and failed to provide adequate training and supervision so he could safely perform his job.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other relief to which he may be entitled. He is represented by George Farah and Nathan Inurria of Guerra & Farah PLLC in Houston.
