Furniture installers sue employer in overtime complaint

HOUSTON — Two furniture installers are suing their employer, Sotero Lozano Jr., who does business as Astros Techs, citing alleged violation of workers compensation acts.

Manuel Hernandez and Roberta Renteria filed a complaint on Feb. 28, in the Houston Division of the Southern District of Texas against Lozano and Astros Techs, alleging that the employer willfully violated the Fair Labor Standards Act.

According to the complaint, Hernandez and Renteria regularly worked for more than 40 hours per week without being paid proper overtime compensations. Instead, they were paid their hourly wages for all hours they worked, the complaint said. The plaintiffs hold Lozano and Astros Techs responsible because the defendant allegedly did not pay to them overtime at the rate of one and one-half their hourly rate for all hours worked in excess of 40 per week and failed to keep adequate time and pay records.

The plaintiffs request a trial by jury and seek award for proper overtime compensation for all hours worked over 40 per week, liquidated damages, attorney fees, costs and expenses and other equitable relief. They are represented by Warren Berlanga of Wyly & Cook LLP in Houston.
