Property owner sues general contractor

Houston resident accuses Philip Tijerina (d/b/a Prime Design & Construction) of breach of agreement.

HOUSTON — A property owner is suing Philip Tijerina d/b/a Prime Design & Construction, a general contractor, citing alleged misapplication of trust funds and conversion.

Ana Fuentes filed a complaint on March 1, in the Harris County District Court against Philip Tijerina d/b/a Prime Design & Construction alleging that the general contractor failed to perform its obligations under the agreement.

According to the complaint, the plaintiff alleges that, in April 17, 2016, the parties entered into a contract for defendant to remodel plaintiff's home for a total costs of $218,534.20, to be completed within two to three months. To date, the remodeling and repair has not been completed. Plaintiff suffered loss of use of her home. The plaintiff holds Philip Tijerina d/b/a Prime Design & Construction responsible because the defendant allegedly failed to substantially complete the project within the specified time period and failed to timely pay subcontractors and suppliers.

The plaintiff requests a trial by jury and seeks monetary relief of over $100,000 but not more than $200,000, costs of court and all other and further relief. She is represented by Tom Wardle of Tom Wardle, Attorney at Law PC in Houston.
