Oklahoma resident accuses employer and driver of negligence

TYLER — A motorist is suing Werner Enterprises Inc. and Alfred D. LaPoole, employer and driver, citing alleged insufficient measures were taken to prevent injuries.

Steve Alan Ebsen filed a complaint on March 1, in the Tyler Division of the Eastern District of Texas against the defendants alleging that they defendant LaPoole failed to exercise ordinary care in the operation of his motor vehicle.

According to the complaint, the plaintiff alleges that, in May 15, 2015, he was traveling South in the left hand lane of SH 19 when defendant LaPoolle, who was in the course and scope of his employment with defendant Werner, negligently made an unsafe and illegal turn across the left hand lane and collided with plaintiff's vehicle. He sustained severe and permanent injuries to his body. The plaintiff holds Werner Enterprises Inc. and Alfred D. LaPoole responsible because defendant LaPoole allegedly failed to keep a proper lookout, failed to properly apply brakes and to take proper evasive action to avoid collision.

The plaintiff requests a trial by jury and seeks damages, interest, costs and such other and further relief to which he may be justly entitled. He is represented by Randy Akin of G.R. Akin PC, Attorney-Mediator in Longview and J.P. Longacre of J.P. Longacre PC in Idabel, Oklahoma.
