PepsiCo accused of disability discrimination

HOUSTON — A Harris County man is suing PepsiCo, alleging disability discrimination and wrongful termination.

Glenn Rodgers filed a complaint March 6, in the Houston Division of the Southern District of Texas against PepsiCo, Inc., New Bern Transport Corporation and Bottling Group LLC, alleging violation of the Americans with Disabilities Act.

According to the complaint, as a result of the defendants’ discriminatory conduct, Rodgers has suffered and will continue to suffer loss of income, emotional pain and suffering, inconvenience and loss of enjoyment of life following his termination Sept. 13, 2015. The plaintiff alleges the defendants failed to provide reasonable accommodation and terminated his employment because of his disability or perceived disability regarding a shoulder injury. The suit says the defendants turned down Rodgers' request to have a weight-lifting restriction of 25 pounds or more.

Rodgers seeks trial by jury, compensatory, punitive and economic damages, reinstatement, interest and all other relief. He is represented by attorneys Dwain G. Capodice and Nasim Ahmad of Ahmad & Capodice PLLC in Houston.
