HOUSTON — Two employees have filed a class action lawsuit against a Conroe tool manufacturing company, alleging violation of workers compensation acts in failing to pay overtime.

Casey Kitagawa and Brandon Sheldon filed a complaint, individually and on behalf of all others similarly situated, March 7 in the Houston Division of the Southern District of Texas against Drilformance LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Kitagawa and Sheldon, starting in 2014 regularly worked more than 40 hours per week as applications engineers but were not paid overtime for hours work in excess of 40 per week. Instead, the suit says, they were paid the same amount every two weeks. 

The plaintiffs allege Drilformance required them to work in excess of 40 hours per week while refusing to compensate them with the applicable overtime premium as required by FLSA.

The plaintiffs seek trial by jury, an order allowing this case to proceed as a collective action, unpaid overtime wages, liquidated damages, attorney fees and costs and all other equitable relief. They are represented by attorneys Warren A. Berlanga and Kelly E. Cook of Wyly & Cook PLLC in Houston.
