HOUSTON — An auctioning company is suing a bidder, citing alleged breach of contract on bids that included the purchase of a Pablo Picasso painting.
Lewis & Maese Auction LLC filed a complaint on March 8, in the Harris County District Court against Brett Stettner, alleging that the bidder failed to perform his contractual obligations.
According to the complaint, the plaintiff alleges that Stettner was a successful bidder for 30 different lots on Sept.21, 2016, for a total cost of $182,450. The plaintiff was entitled to an 18 percent buyer's premium, the complaint said. So the defendant's breach allegedly caused injury to plaintiff as well as the consignee of the items. The plaintiff now seeks actual damages of at least $236,022.51, storage fees included. The plaintiff holds Stettner responsible because the defendant allegedly failed to make payments for any of the item for which he was the successful bidder.
The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000, but not more than $1 million, and all such other relief to which plaintiff is justly entitled. He is represented by Bradford W. Irelan of Irelan McDaniel PLLC in Houston.
