Injured passengers sue Ford, car owner

Car accident 29

HOUSTON — Two passengers are suing driver Christian Aubry Kennaugh and Ford Motor Co, citing alleged negligence and product liability after the passengers were injured in a crash.

Danielle Allise Simien and Ashley Elise Gresham filed a complaint on March 8 in the Harris County District Court against the defendants, alleging that defendant Ford negligently manufactured the vehicle involved with defective pretensioners.

According to the complaint, Simien and Gresham were passengers in a 2013 Ford Fusion being driven by its owner, defendant Kennaugh, when the vehicle collided with another vehicle and struck a pole near a service road. They sustained severe injuries when the pretensioners in the vehicle's seat malfunctioned, the complaint said. The plaintiffs hold Kennaugh, a Tomball resident, responsible because Kennaugh allegedly failed to maintain proper control of the vehicle and failed to stay on her lane of travel and to take proper evasive actions to avoid collision.

The plaintiffs request a trial by jury and seek compensatory and exemplary damages, costs of court, interest and all other relief. They are represented by John M. Padilla, Steve Hollingsworth and Alex Gonzalez of Padilla & Rodriguez LLP in Houston and David Salazar of the Salazar Law Firm PLLC in Houston.
