Bank alleges couple failed to pay instalment balance

GALVESTON — A bank is suing a Galveston County couple, alleging breach of contract in failure to pay an installment due for an auto purchase.

Southwest National Bank filed a complaint March 10 in Galveston County District Court against Bruce Lee Kirgan and Nicole Diane Kirgan, alleging they failed to pay balance of a Chevy truck.

According to the complaint, on Feb. 27, 2012, the defendants signed a retail installment contract with Southwest National for the purchase of a 2010 Chevrolet Silverado truck from Newberry Family Auto. 

The plaintiff alleges the Kirgans have failed to pay installment due balance of $3,297.12, inclusive of interest and fees.

Southwest National Bank seeks trial by jury, judgment for $3,297.12, pre-judgment interest at the contractual rate of 9.84 percent from May 2, 2016, through the date of judgment, at least $1,000 as reasonable attorney fees, costs of court and all equitable relief.
