$1M suit brought over 2015 San Marcos school bus crash

SAN MARCOS - A guardian of one of the children injured in the 2015 bus collision in San Marcos has filed suit against the individual who allegedly caused the crash and the man’s employer.

Seeking up to $1 million in damages, Robyn Hernandez, as next of friend of Krystiana Hernandez, filed suit against Paul Mercado and W.T. Byler Co., Inc. in Hays County District Court.

According to the petition, on March 2, 2015, Mercado was driving a truck entrusted to him by W.T. Byler on State Highway 21 in Hays County when he “plowed” into the back of a San Marcos CISD bus that had stopped to drop off children.

The collision made headlines at the time. 10 children were reportedly hospitalized.

The collision caused Krystiana to be pinned between two seats and caused her serious injuries.

Both defendants are accused of gross negligence, entitling the plaintiffs to exemplary damages.

Houston attorney Chevo Pastrano represents them.
