Injured motorist alleges postal service has failed to pay crash damages

GALVESTON — An injured motorist is suing the U.S. Postal Service, alleging wrongful denial of claims.

Milson Lopez Escobar filed a complaint March 14 in the Galveston Division of the Southern District of Texas against the U.S. Postal Service and the United States of America, alleging they have failed to comply with the Federal Tort Claims Act.

According to the complaint, on April 4, 2015, Escobar when a postal service driver negligently drove his mail truck and collided with the plaintiff's vehicle in Houston. The suit says more than six months have passed since the filing of the claim with the USPS for injuries and damages of approximately $153,000. 

The plaintiff alleges the defendants have denied to make payment for Escobar's claim for injuries and damages.

Escobar seeks trial by jury, judgment against each defendant for $153,000 and all other equitable relief. He is represented by attorneys Walter L. Boyaki of Boyaki Law Firm in El Paso, and by Heriberto Ramos of Ramos & Associates in Houston.
