Employee accuses health care group of unpaid wages

MARSHALL — An employee is suing a Texas health care company, alleging violation of workers compensation acts.

Carmella B. Miller filed a complaint March 15 in the Marshall Division of the Eastern District of Texas against Concord Healthcare Group LLC, doing business as Gardendale Rehabilitation and Nursing Center, alleging violation of the Fair Labor Standards Act.

According to the complaint, as a result of Gardendale's refusal to pay proper compensation, Miller has suffered and continues to suffer monetary damages for not receiving the full wages she is entitled to. 

The plaintiff alleges the defendant failed to pay for her hours worked in excess of 40 per week at a rate not less than one and one-half times her regular hourly rate of pay as required by FLSA.

Miller seeks trial by jury, compensatory and liquidated damages, costs of court, attorney fees, expenses and all other just relief. She is represented by attorney Bob Whitehurst of Tyler.
