Child care center employee falls while helping teen with cerebral palsy, pursues legal action with husband

GALVESTON – A Brazoria County couple is suing a Dickinson child care facility where the woman works after she allegedly sustained injuries while assisting a teenager with cerebral palsy.

Jessica and Samuel Harkreader’s lawsuit, filed against Lifetime Academy of Learning LLC on Apr. 5 in the Galveston County 10th District Court, claims the Aug. 14, 2015 incident occurred when Jessica Harkreader helped the adolescent use the restroom only for the student to fall onto her.

She then fell “forcefully onto the floor of the bathroom” and suffered injuries to her shoulders, arms, spinal disc, and other parts of her body, recent court documents state.

The suit explains that the defendant, doing business as A Lifetime of Learning Child Care Center, declined her request for additional assistance prior to performing the task.

Samuel Harkreader says that his wife’s ordeal caused him to suffer a loss of consortium.

Consequently, the complainants seek unspecified monetary damages.

They are represented by attorney Scott P. Armstrong of the law firm Abraham, Watkins, Nichols, Sorrels, Agosto & Aziz in Houston.
