Visitor blames Cypress apartment operators for injuries

Slip01

HOUSTON — A Cypress woman is suing local apartment operators, alleging their negligence caused her to suffer injuries.

Ana Concha filed a complaint March 17 in Harris County District Court against Windhaven Homeowners Association, Firstservice Residential Houston Inc. and Principal Management Group of Houston, alleging they breached their duty to exercise reasonable care in maintaining and inspecting the walkway of their Cypress property.

According to the complaint, on March 17, 2015, Concha was an invitee on the 8500 E. Windhaven Terrace Trail, property in Cypress owned, operated and/or maintained by the defendants when she violently fell and hit the floor due to an uneven surface. The lawsuit states Concha suffered a broken finger and other injuries, plus physical impairment and lost wages.

The suit says the defendants failed to ensure that the walkway remained safe at all times and failed to provide adequate warning that a dangerous condition existed in the area where Concha fell.

Concha seeks trial by jury, damages up to $1 million and all other relief to which she is justly entitled. She is represented by attorney Richard A. Hinojosa of Hinojosa Law PLLC in Houston.
