Lawsuit: negligence during dishwasher delivery led to girl's drowning death in pool

HOUSTON – A Harris County woman is suing a shipping and trucking company after her daughter drowned to death in a neighbor’s pool.

Brittney Saenz, in a lawsuit filed Apr. 11 in the Harris County 61st District Court, explains that employees working for G Texas Install Delivery, LLC failed to take precautionary measures while delivering a new dishwasher to a Pasadena couple.

Per the suit, the couple instructed the company’s workers to keep the gate to their backyard closed while delivering the dishwasher to their home, to which the latter neglected to do.

The delivery personnel allegedly propped the gate open with a pad stone and left it that way after using it. Moments later, the couple’s son screamed that there was a little girl in the pool.

Saenz says that she was outside looking for her daughter, who had autism, when she heard the screaming in question. She rushed to the house to find the older male neighbor trying to resuscitate her daughter to no avail, court papers say.

The homeowners are not a party to the case, but Home Depot U.S.A., Inc. is a co-defendant by virtue that the dishwasher came from their business.

Consequently, the plaintiff seeks unspecified monetary damages and a jury trial.
