Customer blames restaurant operator for fractured knee

HOUSTON — A Harris County woman is suing a La Porte restaurant operator, alleging negligence led to her suffering a broken kneecap. 

Peggy Kuykendall filed a complaint March 31 in Harris County District Court against American Food LLC, alleging the defendant breached its duty to ensure the safety of its guests.

According to the complaint, on Sept. 15, 2016, Kukykendall entered the defendant's Popeye's Louisiana Kitchen in La Porte when she slipped and fell on a recently mopped floor. She landed on her leg and fractured her kneecap, the suit says. 

The lawsuit states Kuykendall has incurred substantial medical expenses and suffered extreme pain and physical impairment. The plaintiff alleges the defendant failed to properly train and supervise its employees and failed to implement reasonable policies and procedures regarding the use of signage when mopping the floor.

Kuykendall seeks trial by jury, judgment of more than $100,000, plus interest, costs of court and all other just relief. She is represented by attorneys Clifford D. Peel II of Houston and Shane Pellerin of Shane Pellerin Law Firm PC in Deer Park.
