Customer accuses auto lender of phone harassment

LONGVIEW — A White Oak woman is suing a subprime auto lender, alleging violation of telephone harassment statutes.

Gwynn Shipman filed a complaint April 3 in the Tyler Division of the Eastern District of Texas against Exeter Finance Corp., alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in August 2014, shortly after obtaining an automobile loan from Exeter Finance, Shipman started receiving unwanted calls on her cellular telephone number. 

Shipman alleges she spoke with the defendant's customer service representatives, a supervisor and sent a written letter demanding to stop all cellular calls that included prerecorded voice and automatic telephone dialing system message. Despite such requests, the suit states, the calls continued throughout 2016 until March 2017. As a result, Shipman says she suffered intrusion into her life, invasion of her privacy and it became a private nuisance. 

Shipman alleges the defendant failed to get any consent before placing its calls and failed to respect the numerous written and oral requests of Shipman to cease placing calls to her cellular telephone number.

Shipman seeks trial by jury, judgment to enjoin the defendant from placing additional calls, damages and all relief as the court deems just and proper. She is represented by attorney Aaron D.
