USPS delivery carrier blames property operators for injuries

HOUSTON — A USPS delivery carrier is suing Houston property owners, alleging their negligence led to injuries for the plaintiff. 

Rick Pitre of Houston filed a complaint March 31 in Harris County District Court against SFRA III LLC, Amherst Holdings LLC, Main Street Renewal LLC and Sarah Ann Nelson, alleging they breached their duty to make a dangerous condition reasonably safe.

According to the complaint, on Jan. 18, 2016, Pitre was walking toward the door of a home at 4939 S. Cancun, Houston. As the door opened, the suit says, a dog escaped.

The lawsuit states Pitre quickly backed away, then tripped and fell on an extended walkway. He said he he suffered a left elbow fracture and displaced radial hip fracture that resulted in medical expenses, physical and mental pain and lost earnings. 

The plaintiff alleges the defendants failed to warn him of the unsafe condition and failed to remedy it

Pitre seeks trial by jury, damages of more than $1 million, pre- and post-judgment interest, costs of court and all other legal and equitable relief. He is represented by attorneys Paula Elliott Estefan and J. Wayne Little of Elliott & Little in Conroe.
