HOUSTON — A Houston man is suing General Motors, alleging breach of implied and express warranties.
Samuel Collins filed a complaint March 31 in Harris County District Court against General Motors LLC, alleging failure to comply with the Magnuson-Moss Warranty Act.
According to the complaint, on June 8, 2016, Collins purchased a 2015 Cadillac Escalade from GM's authorized seller for $63,695. Shortly after taking the vehicle, the suit says, Collins experienced defects with the car. He says the defects substantially impaired the Escalade's use, value and safety.
The plaintiff alleges General Motors' representatives failed to repair the vehicle in a good and workmanlike manner.
Collins seeks trial by jury, seeks revocation of acceptance, monetary relief of up to $49,999, costs of court, attorney fees and all other just and proper relief. He is represented by attorneys Erik S. Rahman and John D. Barker of Krohn & Moss Ltd. in Chicago.
