Inspector alleges construction company failed to pay overtime

GALVESTON — A North Carolina man is suing a construction company, alleging violation of workers compensation acts in not paying overtime.

Euwell Falconer, individually and on behalf of all others similarly situated, filed a class action complaint April 5, in the Galveston Division of the Southern District of Texas against Morris-Shea Bridge Company Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, for three years Falconer regularly worked more than 40 hours per week as an inspector without being compensated at the rate of one and one-half times his regular rate of pay for all hours worked in excess of 40 per week as required by FLSA. The plaintiff alleges Morris-Shea Bridge required him to work for more than 40 hours a week and mis-classified him as exempt from overtime under the FLSA.

Falconer seeks trial by jury, an order designating this complaint as a collective action, unpaid overtime compensation and liquidated damages, attorney fees and court costs and all other appropriate relief. He is represented by attorneys Beatriz Sosa-Morris and John Neuman of Sosa-Morris Neuman, Attorneys at Law in Houston.
