Husband blames Kia Motors for wife's injuries

HOUSTON — A Harris County man is suing Kia, alleging the automobile manufacturer's negligence caused serious injuries to his wife. 

Raul Alvarez, individually and as authorized representative of Nancy Alvarez, filed a complaint April 11 in Harris County Circuit Court against Kia Motors America Inc., alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, on May 15, 2016, Nancy Alvarez suffered a horrific car accident that almost killed her when the airbags of her 2007 Kia Rio vehicle failed to deploy. As a result, Raul Alvarez suffered mental anguish and incurred medical and related health care expenses while his wife suffered severe physical pain and and impairment. 

The plaintiffs allege Kia Motors failed to market the Kia Rio with adequate warnings and/or instructions regarding the dangers and risks of airbag non-deployments and failed to design the Rio so that the airbags would deploy during an accident.

The Alvarezes seek trial by jury, more than $1 million in damages, pre- and post-judgment interest, attorney fees, costs of court, and all other equitable relief. They are represented by attorneys Joshua P. Davis and Katherine Ray of Davis Law Group in Houston.
