Biological son accuses father's ex-wife of fraud

GALVESTON — A biological son is suing his father's ex-wife, alleging fraud and breach of a settlement agreement.

John Barr Stapp, executor of the estate of Bruce Barr Stapp, filed a complaint April 28 in Galveston County District Court against Janet Elaine Stapp, alleging she breached her duty of good faith and fair dealing.

According to the complaint, as a result of Janet Elaine Stapp's refusal to abide by the settlement agreement regarding family property in Galveston County, John Barr Stapp has suffered undue financial hardship and burden, emotional distress and other consequential damages, plus attorney fees. 

The plaintiff alleges Janet Elaine Stapp failed to execute any and all documents necessary to transfer her interests to the plaintiff and has refused to sign the general warranty deed, releasing her interest in the Galveston County property.

John Barr Stapp seeks trial by jury, monetary relief between  $200,000 and $1 million and all other just relief. He is represented by attorney Chad T. Wilson of Chad T. Wilson Law Firm PLLC in Webster.
