Seeking less than $100,000 in damages, Sarah Jackson filed her suit April 26 in Jefferson County District Court.
According to the lawsuit, on July 21, 2014, Jackson purchased a BMW from Mike Smith BMW for $40,000.
“Since purchase, the vehicle has encountered an excessive number of defects, including … the fuel engine system, engine noise, stalling, oxygen sensors and the check engine light,” the suit states.
“The vehicle has been in the shop at least 4 times and spent approximately 45 days in the shop. The vehicle still has problems with the check engine light and is currently in the shop undergoing repairs.”
Jackson is suing for actual damages and for additional damages under the Deceptive Trade Practices Act.
