Daycare center owner accuses contractor of fraud

HOUSTON — A Harris County daycare center owner is suing a general contractor, alleging fraud and unjust enrichment.

Madhumita Mukherjee filed a complaint May 2 in Harris County District Court against First National Homes Inc., alleging failure to perform its contractual obligations.

According to the complaint, Mukherjee suffered substantial financial injury and damages, including lost profits, time and effort and loss of business reputation because First National walked off the project without finishing the new daycare center. The suit says Mukherjee was forced to hire a new contractor to complete the daycare center project. 

The plaintiff alleges First National Homes failed to complete the plaintiff's project on schedule and within specifications and failed to pay its subcontractors.

Mukherjee seeks trial by jury, monetary relief of between $200,000 and $1 million and all other lawful and equitable relief. She is represented by attorneys Sean A. Roberts, Clive Markland and Rob A. Cantu of Roberts Markland LLP in Houston.
