Customer alleges Luby's violated federal debit card law

HOUSTON — A Fort Bend County man filed a class action lawsuit against Luby's, alleging violation of federal law regarding debit card information.

John B. Woods filed a complaint, individually and on behalf of a class of similarly situated persons, April 13 in the Houston Division of the Southern District of Texas against Luby's Inc. alleging the defendant printed more than five digits of the plaintiff's debit card number on the receipt.

According to the complaint, in April and May 2016, Woods was damaged from having more than five digits of his debit card printed on the receipt, which can lead to identity theft. The plaintiff alleges Luby's failed to issue a FACTA complaint receipt to Woods that displayed more than five digits of his VISA debit card.

Woods seeks statutory damages of $100 to $1,000 per violation, attorney fees, court costs and all other proper relief. He is represented by attorneys Phillip A. Bock and Tod A. Lewis of Bock, Hatch, Lewis & Oppenheim LLC in Chicago.
