Homebuyers accuse builders of shoddy construction

HOUSTON — A Harris County couple is suing a Houston home builder, alleging construction defects.

Rachel Dunn and Adam Dunn filed a complaint on May 5, in the Harris County District Court against Midani Homes LLC alleging that the home builder breached the implied warranty of good and workmanlike construction.

According to the complaint, on June 23, 2015, the Dunns purchased a new home from the defendant at 11109 Beinhorn Drive, Houston. Since they moved in, the suit says, the Dunns have experienced significant defects to their home, which caused property damage and created unsafe conditions. 

The Dunns say they have expended approximately $220,000 to repair their home. The plaintiffs allege Midani Homes failed and refused to perform its contractual obligations.

The Dunns seek trial by jury, monetary relief between $200,000 and $1 million, plus all other appropriate relief. They are represented by attorneys Timothy C. Ross and Lauren Scroggs of Andrews Myers PC in Houston.
