Homeowners allege contractors failed to fix defects

HOUSTON — Two Houston homeowners are suing contractors, alleging breach of warranties.

Terri D. Cook and Kenneth L. Vollbrecht filed a complaint May 8 in Harris County District Court against GKS Partners LLC and David Kae Custom Homes LLC, alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, after Cook and Vollbrecht moved into their new home at 319 Peden, Houston, they noticed moisture and water leaks. The suit says they continue to suffer damages from each leak event. 

The plaintiffs allege the defendants have failed to perform work according to applicable warranties and building codes and have failed and refused to correct damages to the plaintiffs' home.

Cook and Vollbrecht seek trial by jury, damages and all other relief. They are represented by attorney Gregory M. Clark of Coats Rose in Houston.
