Tranzonic Companies, CCP Industries Inc. accuse former employee of violating agreement

HOUSTON —Two suppliers of cleaning, maintenance and safety products are suing its former area manager, citing alleged breach of contract and tortious interference.

Tranzonic Companies and CCP Industries Inc. filed a complaint on April 21 in the Harris County Circuit Court against Shawn Swonke, alleging that he failed to comply under a signed agreement of confidentiality, non-solicitation and non-competition agreement.

According to the complaint, the plaintiffs allege that after hiring defendant Swonke, they entered into confidentiality agreement that prohibited the defendant from soliciting their customers for his personal benefit. 

The plaintiffs claim that they have received notice from a customer that the defendant has solicited or attempted to solicit customers on behalf of Armchem International Corporation, a rival company. As a result, the plaintiffs claim that they had lost customers and revenue. 

The plaintiffs hold Swonke responsible for allegedly soliciting its customers or potential customers on behalf of a rival company and disclosed private company information to the rival without legal consent.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, attorneys' fees, costs and other relief the court deems just and required under the circumstances.
