Customer blames mall operators for wheelchair incident

HOUSTON — A disabled Harris County woman is suing Katy mall operators, alleging negligence led to her injuries. 

Caroline Thomas filed a complaint May 15 in Harris County District Court against Katy Mills Mall, Simon Property Group LP and Katy Mills Mall Ltd. Partnership, alleging they breached their duty to provide a safe premises.

According on July 26, 2015, Thomas was leaving Katy Mills Mall after shopping when her wheelchair became caught in a hole, causing her to fall forward on her hands and knees. The incident, the suit says, caused Thomas injuries and damages. 

Thomas says she experienced pain and suffering, mental anguish and medical expenses. The plaintiff alleges the defendant negligently permitted the existence of a dangerous condition and failed to correct such condition.

Thomas seeks trial by jury, monetary relief between $200,000 and $1 million and all other just and equitable relief. She is represented by attorney M. Andrew Seerden of The Seerden Law Firm PLLC in Houston.
