Two mechanics allege employer failed to pay overtime

MARSHALL — Two mechanics are suing their Marshall employer, alleging violation of workers compensation acts in failing to pay overtime.

Billy Hollan and Joey Lusk filed a complaint May 19 in the Marshall Division of the Eastern District of Texas against Thunderbird Resources LP alleging violation of the Fair Labor Standards Act.

According to the complaint, Hollan, who began working for Thunderbird in 2012, and Lusk, who started work for the defendant in 2014, suffered monetary damages because they were not paid overtime wages at one and one-half times their regular rate for all hours worked in excess of 40 per week as required FLSA. 

The plaintiffs allege Thunderbird Resources intentionally failed to pay plaintiffs overtime wages.

Holland and Lusk seeks trial by jury, unpaid wages, liquidated damages, attorney fees, costs of court and all other relief the court deems just. They are represented by attorney Michael A. Benefield of Benefield Law in Greenwood, Indiana.
