Children blame health care providers for mother's death

Medical malpractice 06

BEAUMONT — Four children are suing Jefferson County health care providers, alleging the defendants' negligence led to the death of their mother.

Toby Wayne Stevens, individually and as representative of the estate of Ola Mae Byrd, deceased, Mary Jane Stevens, Darrell J. Byrd Sr. and Lasha Marie Byrd Fleming filed a complaint May 12, in Jefferson County District Court against PM Management - Golden Triangle NC LLC, doing business as Summer Place Nursing & Rehabilitation, alleging they breached their duty to provide Ola Mae Byrd appropriate care.

According to the complaint,  as a result of the defendants' negligence, Ola Mae Byrd suffered deterioration of health, physical and mental injuries and damages, resulting in her untimely death. The plaintiffs say they have suffered the loss of companionship and society of Ola Mae Byrd.

The plaintiffs allege the defendants failed to correctly asses Byrd's medical condition, failed to intervene in a timely manner and failed to hire and train appropriate and competent personnel.

The plaintiffs seek trial by jury, actual and exemplary damages, pre- and post-judgment interest, costs of suit and all other just and proper relief. They are represented by attorney Michael C. Howard of Houston.
