Worker accuses medical group of not paying overtime

Late 03

GALVESTON — A Brazoria County woman is suing a Lake Jackson health care group, alleging violation of workers compensation acts in not paying proper overtime.

Patricia Pace filed a complaint May 24 in Galveston Division of the Southern District of Texas against CHI St. Luke’s Health Brazosport, alleging violation of the Fair Labor Standards Act.

According to the complaint, Pace suffered damages for not receiving overtime compensation at a rate of one and one-half times her regular hourly rate for all hours worked in excess of 40 per week as required by FLSA.

The plaintiff alleges CHI St. Luke’s Health Brazosport altered her submitted hours to minimize overtime hours worked and failed to pay proper amount of overtime for her work between 2011 and 2017 as a medical transcriptionist in the defendant's radiology department.

Pace seeks trial by jury, all unpaid overtime premiums, liquidated damages, attorney fees, court costs and expenses and all other equitable relief. She is represented by attorneys Beatriz Sosa-Morris and John Neuman of Sosa-Morris Neuman in Houston.
