Ellis Décor employee trips over clutter, sues for $1M

BEAUMONT – Ellis Décor and Garden is facing a trip and fall lawsuit.

Seeking up to $1 million in damages, Bonnie Ponce filed suit against the company on May 23 in Jefferson County District Court.

According to the lawsuit, on Jan. 11 Ponce was an Ellis Décor employee working at the store in Beaumont “when she tripped over clutter” and injured herself.

The suit fails to state a specific act of negligence committed by the defendant, which did not have worker’s compensation coverage for its employees.

“Therefore, plaintiff alleges there is no comp bar to her suit,” the suit states.

Ponce is suing for here past and future medical expenses, pain, mental anguish, disfigurement and impairment.

She is represented by Jon Burmeister, attorney for the Moore Landrey law firm in Beaumont.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
