Customer accuses cabinet manufacturer, Home Depot of breach of warranty

HOUSTON — A Harris County man is suing Home Depot, alleging breach of implied and express warranties.

Steven Newman filed a complaint May 30 in Harris County District Court against Home Depot USA Inc. and American Woodmark Corporation, alleging violation of the Deceptive Trade Practices Act.

According to the complaint, Newman was damaged for buying defective cabinets manufactured by American Woodmark and sold by Home Depot. Newman says he timely reported the defects and requested remediation and payment for damages but the defendants declined to undertake remediation and to compensate the plaintiff's damages.

Newman seeks trial by jury, compensation for all damages, pre- and post-judgment interest, costs of court and all other just and equitable relief. He is represented by attorney Steven A. Hershkowitz of Houston.
