Couple blames express carrier for crash

TYLER — A Smith County couple is suing an express carrier, alleging its negligence caused a crash that injured the husband. 

David Hair and Theresa Hair filed a complaint May 31 in the Tyler Division of the Eastern District of Texas against Averitt Express Inc., alleging the motor carrier negligently entrusted the vehicle to an employee, who was careless, incompetent and reckless.

According to the complaint, on Dec. 9, 2015, David Hair was lawfully operating his vehicle on state Highway 155 when a a truck trailer and semi trailer operated by Bernasko Reddic,  an employee of Averitt, pulled out in front of Hair, causing a collision. The suit says Hair suffered severe and permanent disabling injuries, and Theresa Hair suffered loss of consortium and household services of her husband. 

The plaintiffs allege Averitt Express' employee failed to safely make a left-hand turn and failed to yield the right of way to David Hair.

The Hairs seek trial by jury, actual, punitive and/or exemplary damages, plus legal interest, cost of court and all other just relief. They are represented by attorneys Jimmy M. Negem and Joe M. Worthington of Negem & Worthington in Tyler.
