Customer blames Kroger for injuries

PALESTINE — An Anderson County woman is suing Kroger, alleging the store's negligence caused injuries.

Sue Hardy filed a complaint June 1, in the Anderson County District Court against The Kroger Co., Kroger Texas LP and Kroger Group Cooperative Inc., alleging breaching their duty to maintain the premises in a reasonably safe condition.

According to the complaint, on July 2, 2016, Hardy was at the Kroger store in Palestine when the electric shopping cart she was operating in the parking lot flipped over on her way to the disabled parking lot after traveling over a depression. The suit says Hardy broke her arm and sustained other injuries, resulting in pain and suffering, mental anguish and medical expenses. 

The plaintiff alleges Kroger negligently designed and constructed the premises in a dangerous condition.

Hardy seeks trial by jury, monetary relief between $200,000 and $1 million, plus interest, costs of court and all other legal and equitable relief. She is represented by attorney Clint E. McGuire of Martinez & McGuire PLLC in Houston.
