GALVESTON — A Houston woman has filed a class action lawsuit against a communications business, alleging violation of workers compensation acts in failing to pay overtime.
Cindy Silva, individually and on behalf of all others similarly situated, filed a complaint June 2 in the Galveston Division of the U.S. District Court for the Southern District of Texas against Intec Communications LLC, alleging the employer intentionally violated the Fair Labor Standards Act.
According to the complaint, Silva regularly worked more than 40 hours in a week starting in October 2015 performing cable and security installations without receiving overtime wages. The plaintiff alleges Intec Communications failed to compensate her at the rate of one and one-half times her regular pay for all hours worked in excess of 40 a week as requited by FLSA.
Silva seeks trial by jury, an order designating this case as a collective action, all unpaid overtime compensation and liquidated damages, attorney fees and court costs and all necessary and appropriate relief. She is represented by attorney Don J. Foty of Kennedy Hodges LLP in Houston.
