Mississippi couple blames Harris County medical care providers for wife's pain, injuries

HOUSTON — A Mississippi couple is suing Bellaire medical care providers, alleged medical negligence. 

Elizabeth Shadix and James Shadix filed a complaint May 30 in Harris County District Court against Orthopaedic Associates LLP and Dr. Vivek P. Kushwaha, alleging Kushwaha failed to properly perform what an orthopedic surgeon should have done under the same circumstances.

According to the complaint, on March 7, 2016, Kushwaha's performed a revision on Elizabeth Shadix's L5-S1 laminectomy and discectomy. As a result of Kushwaha's negligence, the suit says, she suffered injuries resulting in physical and mental pain, disfigurement, lost earnings and medical expenses. 

James Shadix says he suffered loss of consortium and the household service of his wife. The plaintiffs allege Kushwaha failed to properly decompress the disc space when he performed the surgery.

The plaintiffs seek trial by jury, monetary relief of more than $1 million, pre- and post-judgment interest and all other just relief. They are represented by attorneys Charles R. Houssiere and Randal A. Kauffman of Houssiere, Durant & Houssiere LLP in Houston.
