Four workers allege employers failed to pay overtime

HOUSTON — Four employees have filed a class action lawsuit against home care and elder care employers, alleging alleged violation of workers compensation acts in failing to pay overtime.

HOUSTON — Four employees have filed a class action lawsuit against home care and elder care employers, alleging alleged violation of workers compensation acts in failing to pay overtime.

Lee An Fuentes, Elisa Montgomery, Shara Grubbs and Samantha Stewart, individually and on behalf of all others similarly situated, filed a complaint June 8 in the Houston Division of the Southern District of Texas against Brema Investments LLC, doing business as  Grisworld Homecare and Brenda Gross, alleging they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs suffered monetary damages for not receiving overtime compensation at the rate of not less than one-and-a-half times their regular rates of pay for all hours worked in excess of 40 a week as required by FLSA. The plaintiffs allege the defendants misclassified them as exempt from the overtime provision of the FLSA and did not pay them overtime premium and failed to keep proper time records.

The plaintiffs seek trial by jury, an order allowing this case to proceed as a collective action, back pay, unpaid overtime wages, lost wages, liquidated damages, interest, costs, attorney fees and all other just and proper relief. They are represented by attorneys Terrence B. Robinson and Laura A. Hernández of TB Robinson Law Group PLLC in Houston.
